You cannot drive until this process is complete. Operating a CMV after a confirmed violation — before passing the RTD drug test — is a federal offense. Do not return to work until your SAP clears you and you have a negative RTD test result in hand.

The moment a violation is confirmed (positive MRO-verified result, refusal, or ≥0.04 alcohol), your employer must immediately remove you from all safety-sensitive functions. You cannot drive, load/unload hazmat, or perform any regulated duty. This is not optional for the employer.
You must see a DOT-qualified Substance Abuse Professional (SAP) for a face-to-face clinical evaluation. The SAP assesses the violation, your history, and your situation — then prescribes a specific education or treatment plan. The SAP's recommendation is mandatory; you cannot negotiate it down.
You must complete whatever the SAP prescribed — a substance abuse education program, outpatient treatment, inpatient treatment, or some combination. The timeline here is entirely driven by the SAP's plan.
After completing the prescribed program, you return to the SAP for a follow-up evaluation. If the SAP determines you have complied with all recommendations, they authorize a return-to-duty drug and/or alcohol test.
The RTD test is a standard DOT 5-panel urine test, but it is directly observed collection. It must be performed at a DOT-certified collection site with a certified collector.
The SAP creates a follow-up testing plan — the minimum is 6 unannounced tests in the first 12 months back at work. The plan can extend up to 60 months. Testing is unannounced; you will not know when the next test is coming.

Yes. You have the right to choose any DOT-qualified SAP. Your employer can provide a list, but cannot require you to use a specific one. The SAP must be listed on a legitimate DOT SAP roster and hold the required credentials (licensed counselor, social worker, psychologist, or physician with substance abuse specialty).
The violation follows you via the FMCSA Clearinghouse. Any new employer running a pre-employment query will see the violation. You cannot bypass the RTD process by switching employers. The new employer will see the incomplete RTD status and cannot put you in a safety-sensitive role until RTD is completed.
Federal regulations do not specify who pays. Most employers require the driver to pay for SAP evaluation and treatment. The RTD drug test is typically the driver's responsibility. Some employer assistance programs (EAPs) may cover some costs. Check your employment agreement.
